For the most part it's not a big enough deal, would only generate negative optics, and is somewhat shaky if they could even persue the case to a conviction, and Nintendo/TPC issuing a legal case that echoes into the wind of international foot dragging would look horribly bad.
If they can get their hands on him reliably, it could happen, but more than likely, if he doesn't push it with the builds for unreleased games or employee data, or doesn't trip up and become really easy to get, it'll end in fucking nothing. Nintendo has very little to gain from it, and a lot to lose in terms of optics and reputation if they make a fuss over it that falls flat.
