The act of recruiting monsters for a party is a concept, you can't patent that but HOW you recruit monsters is something you could patent. Atlus could have patented demon negotiation but that wouldn't have prevented the pokeball or the other methods of recruitment in the genre like Cyber Slueth's scanning because they're all different ways to do the same thing.
