I think part of why media is stagnating and eating its own tail so hard right now is that there's not really a good way for weirdoes to congregate and make neat things that will go on to be cultural touchstones for decades anymore, and most of the people doing any writing are just normies.
4chan is one of the last bastions of weirdoes, and even here is still heavily infected with outside disruption, its days of making things 10 years behind it.

The closest to allowing fan works is Shinkokuzai, the thing that allows doujins, which just says that not complaining is considered tacit approval when it comes to criminal prosecution. Which of course then forces companies to have to complain every time unless they just don't care about others using their copyrighted material at all for their own works.
Shinkokuzai is also used in their sexual assault law, which is why they have kind of a big problem with that for a country with otherwise a pretty low crime rate. The state can't prosecute unless a victim publicly steps forward with a complaint.
