But at the same time, there are infinitely more Fakemon designs out there than Pokemon designs. At some point, no matter what they come up with, some element of it will match a design that already exists.
Take Scovillain for example. It's a simple monster with two bell pepper heads. And turns out, someone already did that exact concept years prior:
https://www.youtube.com/shorts/UafCj2_PcpUIts incredibly similar, but I don't think the artist could ever successfully take this to court. Ignore the difference in funds between the artist and the Pokemon Company. Just from a creative/copyright standpoint.
Another example is Palworld, with Pals that are blatantly inspired by different Pokemon. But their designs are fine and NOT what Pokemon and Nintendo are trying to sue the Palworld devs for.
So say that they did decide to go through with the Flying-type Eevee evolution, and the artist who made a design very similar tries to sue or claim the design was stolen? How successful would they actually be if they tried?
I get not wanting to look at Fakemon from an artistic integrity and legal CYA standpoint, but there are so many more Fakemon designs than Pokemon designs out there.
t what the Pokemon Company is trying to do here; Nothing wrong with a little CYA, but at this point, is that really even necessary?
Like we will surely hit a point where there are simply too many Fakemon designs out there that it would become nearly impossible to come up with something that does not at least somewhat resemble part of a Fakemon design.
So why kneecap potential real Pokemon designs?
