The Pokemon themselves are trademarked, but fair use will greatly diminish their protections at that point, so we would expect that to be the tipping point where it becomes less economical to make Pokemon games. In that scenario, there will still only be about 3200 Pokemon. Is that a lot? Yes. Is that an entirely doable number to work with? Yes. There are modern games with more distinct models and give how much model reuse there is in Pokemon (many Pokemon are still using their original Pokedex 3D model) I think GameFreak would be fine. It's laziness, pure and simple. My hope is that as AI improves, the process of creating and importing 3d models gets easy enough to the point that one guy with an AI could import all previous Pokemon into a new game. Once we hit that point we could see full Pokedex games again.
