If Nintendo picked a fight with Bamco, and then Ultraman Capsules Kaiju got formally recognized as something TPC has been infringing on for example, Nintendo as a whole could go under overnight if they suddenly had to cough up 20% of the gross profit Pokemon has ever made on the spot and immediately cease the sale of Pokemon related products. Even if it DIDN'T explode like that, and Nintendo actually won, Bamco blacklisting Nintendo afterwards would do catastrophic damage to their ability to function as a producer of video games, far more than Nintendo would win.
Nintendo and TPC are largely only able to get away with what they do because they only chimp out against smaller entities. If they ever actually pissed anyone significant off they would die very quickly.
TPCs response when threatened by anyone sufficiently large, is just copy them and follow the leader. It's what happened with Yokai Watch, and it's pretty obviously happening with Palworld after that wound up being a bit more than Nintendo thought it could chew.
