If nobody from Hololive or Nijisanji strikes back claiming that they're not 個人事業主 and the 労働契約法 and 労働基準法 should apply to them as they're effectively employees, then the glass shield their respective companies have protecting them will never shatter. It is an unchallenged legal loophole.
