If neither is outright drunk but just loosened up, that's called "having sex you might regret later", but it's not rape. It's also REALLY hard to legally prove wrongdoing when both parties have fuzzy memories.
That being said, I wish I didn't read anon's story last night. Good for him and all, I want to give the guy a high five, but it filled me with so much self-loathing in the hours later over my own failures and missed opportunities that it caused me to drink, something I never do ever. I still haven't slept since.
