It's one thing, to own a copy of the game and the hardware, but another thing to stream the game. And different states have different laws. It's funny how several publishers forbids to decompile software in their license agreements and EU law just says: You may do it for studying purposes and you are even allowed to fix the software in a limited way.
Both wouldn't apply for a modded game. It might be hard to argue, that optimizing the balancing in a game is a fix. And running modded consoles is also against their terms. I'm not sure if there's a paragraph that states, you may only run the software on original (licensed) hardware, but I'm sure there is one. Anyway, situation in Japan might be different.
