There's also the issue where if she was recording him doing something illegal (including talking about doing certain illegal things) then it wouldn't matter if they were in one-party consent jurisdictions at the time of the recording, or two-party consent jurisdictions, or all-party consent jurisdictions. I just hope that this does not apply; this months-long shitstorm is big enough without throwing "livers are doing felonies" into the mix.
