Many indies blend both types of content on the same account, so unless they manually check every time it can be difficult to know if a poster is discussing their vtuber content or IRL content. As a result it doesn't really get enforced for indies unless you directly post their flesh face or there's no vtuber model on screen when you post a screenshot.

Because the rule is outdated. Now it's become a regular thing for nearly all vtubers to blend their irl appearance into discussions and streams. To not talk about it would be to ignore a significant aspect of streams and of twitter accounts
