Commissioning art doesn't give you the full rights to the artwork it unless you agreed to that with the artist beforehand. It's retarded, but that's how it is.

What happens if you commission a derivative piece of artwork without also getting the rights to the new work, but you own the copyright of the original work it is based on?
I would assume then that neither side could make use of the new artwork without permission from the other party.

I would think neither could sell the artwork without contractual agreement by both parties. If he's selling it that seems to be illegal. If he's just listing it as an example of his work it's legal by default unless their contract stipulated otherwise.

She says she got the commercial rights to the image in September, which in turn stops the artist from being able to sell this piece of art on his own.
That is, unless they reached some agreement to put it for sale on this con (which obviously wasn't the case), and even if that were the case, the money would go to her since she essentially now owns anything related to that artwork.
Basically everything in this nothingburger "drama" points toward the artist being retarded

Pretty sure you're thinking of someone else. Vienna has been a streamer for a while even before becoming a vtuber. Vienna is also /here/, or at least she used to be. She actually mentioned /vt/ on stream once and visited /vsj+/ after a collab and answered questions.

She might be well within her right to point something like that out but it's a really dumb move
