Further legal precedent would have absolutely no bearing on them deciding to fire her or not
It's nowhere near as simple as you think it is, you don't lose the right to enforce the rules of a contract if you don't enforce them once, infact you don't lose the right to do so even if you barely ever enforce them, it just becomes easier for them to make a legal defense (which is still a complicated issue with many other factors involved)
