Nintendo has never went after anybody for buying, selling, or using a capture card. Meanwhile, there's a LONG history of Nintendo doing everything they can to try and fuck over CFW, they literally got the laws changed so it's illegal in Japan to sell console mods (unintentionally fucking over capture cards in the process) to try and stop people from installing CFW on the switch, there was leaks that revealed they literally doxxed and stalked a 3DS hacker to try and get him to stop hacking, and there is NUMEROUS examples of them shutting down hacks, because in Nintendo's eyes, CFW and Piracy are two sides of the same coin. They are not the same.
