In general, copyright can be done towards individuals works as sole proprietors (AKA kson before vshojo), but after working on a company, all work done in the company is now protected because you cannot sue an employee individually (but like I said, what normally happens is the company fires, then sues the employee for breaking employment terms).
BUT you must remember that you cannot sue someone for copyright just for commiting it, you need to follow the DMCA process in america (AKA, you must ask to take down the content first, if failed to do so for N days, then sue).
So vshojo and kson without vshojo has nothing to worry about, even though japan is more stricter their vtubers aren't sued individually for playing games without permission, and suing an company or a streamer for streaming a video game is something that has never been done, and if a company failed to sue, then all streamers are protected forever (but it's possible that japan's court might have a case that successfully sues, in that case kson as an individual and all vtubers should be worried)
