This matter was done and over with for years before vtubing even started. We had the monetization wars with Nintendo carpet-bombing copyright strikes in like 2007.
The only potential complication is that the agency as a corporate entity profits from this footage, which does not apply to VShojo as they don't take any cut from on-stream earnings.
However even then, there have already been several companies employing LPers, reviewers, livestreamers, etc. where game permissions just... weren't even part of the conversation.
Permissions are a meme.
