The hot coffee thing was settled out of court because it was better for McDonalds to not suffer the reputation damage, and there is a slim chance that the lack of warning label could actually lead to something, which would have extended the case and cost them more in the long wrong.
It's irrelevant anyways, since they're only targetting Japanese users and only so they can make an example of them to discourage people from doing the same thing. Kind of like when the RIAA sued a few random people for using Napster. which definitely stopped people from illegally downloading music.
