A perfect example of this is a company that helps run election is suing Fox News because Fox News reporters spread lies about them on behest of Trump after he lost the 2020 election and internal communications of Fox News that were handed over as part of court proceedings had smoking guns that Fox News knew they were spreading lies they didn't believe in, but did it anyway because they were just saying what their viewers wanted to keep their ratings up. (Seriously, they consider themselves News channel doing that.)
You'd think the fact they were spreading lies and knew they were lies would make it a slam dunk defamation case, but no, the election company also has to prove Fox News was being malicious while doing it. So there's a chance Fox News can get off the hook by using the 'Nothing personal kid' defense even though their lies caused damage to the election company.
And that doesn't even get into the fact that being a pathological lair is also a way to get out of defamation suits because if you actually believe the lies you're spreading, they can't prove you had malice while spreading the lies.
It's really fucked up.
