1) People who make edits of shit could use the fair use defense in court if they are sued: believe it or not, in and of itself, using material that you do not own for monetary gains is not legal, and fair use must be proven. Is it a big deal? No. Usually it's not, because company don't waste time with people who do edits.
2) Do you need to use things that you do not own to make an impression of someone in a skit? No.
Lumi is a corporate vtuber that used intellectual property that she did not own without permission in a stream in which she made money. Should we care? Probably not. Was it legal? Unlikely.
