The real issue is them trying to retroactively apply it to games released BEFORE the new TOS was put in place. That's definitely pushing legal boundaries since even pulling the game down will still allow people to install the game.
They then say they'll "work with you" on fraudulent installs but I'm willing to bet $100 they'll expect you to pay the full amount first THEN they'll help you.
