I suppose ideally, you could just let people do whatever the hell they want and deduct from their earnings line with taxes. Tell Disney that it’s their fault some fanfiction of Mickey Mouse raping Donald Duck made millions and they should come up with better stories if they want the official stuff to prevail.
But obviously, there’s stuff like image involved, and they always want the agency and power to say no, even when nobody benefits other than the corpos.
