If the only way they can retain them is by pointing at a part in the contract where they can sue them for "joining another corpo in X amount of time", then only an idiot would sign that contract, as they are basically giving the corpo free reign to treat them however the corpo wants and then the corpo can point to the non-compete/legal protection on the contract and make them go back to work.
Honestly, I don't have much issues with what Vshojo is doing, because it's Nijisanji who needs to take care better of their employees to make them stay, and if they leave to join Vshojo like Nina and Mysta, or Selen possibly to VSPOEN or Pomu possibly to Hololive, it's not the fault of the receiving company for hiring the talent, it's the fault of the corpo the talent left for not being capable of keeping them happy and retaining them.
