I'm pretty sure she's using a modded DS, not an emulator. Not that it matters since both are illegal by Japanese law, so I'm surprised she's allowed to to this again. If I remember right, the only legal way to stream DS games is a devkit, and those cost tens of thousands of dollars.

technically you wouldn't even be allowed to use one if you bought it, as that is a breach of contract of the original owner and Nintendo. Pekora had a devkit for her streams because SquareEnix approached her for sponsored streams.

Not doable because, believe it or not, handcam streams are not allowed in NijiJP. Yes it's common in EN and even ID/KR, but they're not allowed in JP. Nijisanji probably worked out something with Nintendo saying "hey, they're vtubers, they can't show hands, they need to be able to capture it from the device directly", to which Nintendo gave them the OK.

They might have given niji some odd exception, but a few years ago Nintendo successfully lobbied to effectively make console modding illegal in Japan. They got a bill passed that made it illegal to profit off modding, so you can't sell any hardware that could be used to mod or charge for it's installation. I assume nijis are using hardware that was modded before that bill was passed.

Also, to be clear, I'm bitching about Nintendo more than Nijisanji right now.

The choppy FPS in her early Tomodachi streams is consistent with Snickerstream, a homebrew that can only be run on a hacked 3DS. Nintendo probably let this slide because they stopped offering the official 3DS capture kits in 2020, so there'd be no way to stream/record the games if they kept the old rules in place. The official capture kits were also very annoying to deal with (Nintendo had to install them in your office, and they bolted them to the floor).
Incidentally Cover seem to have one of those official media units in their office. I think they got it from Square-Enix.

The bottom screen and ONLY the bottom screen ran at like 5fps, which is something that doesn't happen with a capture card, but DOES happen if you use CFW.
