In Japan, it's defamation regardless of whether you can back it up. This is likely because they regard defamation as an undesirable act itself regardless of justification, the same way stabbing a proven rapist unprovoked would still be against the law. The only exception made is if it is in the 'public interest' - aka it involves a government official - in that case, you would be justified in saying they took bribes if they really did, for example, because that has ramifications outside private life.
That said, they do not award very high penalties for defamation. While in the US you can see six or seven figure sums, in Japan the main purpose is to secure a public apology, and you'll be lucky to see 20K out of it.
