>>70651081>Deliberately having to edit them into the photo while "reporting" on strange reflections occuring.Again, he can defend himself that what he said was speculation, which would then lead to the case being immediately thrown out. Nothing in his tweet was presented as fact, if anything, he raised a question.
Speculation CAN NOT be prosecuted under US slander laws, I said this like 5 times now.
>His videos are related because they're clear evidence of him constantly bringing harmful rumors to attentionAnd how does that prove malice? Again, clarify for me specifically how that shows malicious intent for supposed slander in regards to that tweet.
Bringing rumors to attention is not slander. They are just that: rumors. You said it yourself. That means, it's not concrete fact he presented, just rumors.
Which is a non-starter in any US slander case.
TMZ has gotten away with even worse things and they're still around btw.
>Rumors are still textbook defamation, he said he heard of strange rejections and implicated it was because of Nijisanji.Holy fuck, they are NOT textbook defamation.
To quote.
"So, an opinion that's texted or Twittered, no matter how vulgar or shocking, probably can't be the subject of a defamation lawsuit. You can probably say "Person A is the ugliest, dumbest person I've ever met" and not be liable for defamation, because you're voicing an opinion. But if you say "Person A cheated on her tax return," you're opening the defamation door because you've offered up an accusation that can be disproved. "
This is textbook NOT slander-worthy. Rumors fall under speculations, and they can NOT be prosecuted for slander.
>Even if he is legally recognized as a journalist, that doesn't protect him from defamation. You are correct, but he had said nothing that would be classified as slander.
In fact, journalist often get more leeway in slander cases in the US, because they bring news.
> TMZ always gets sued. I'm not claiming Offkai would be sued, I'm saying they obviously wouldn't commit perjuryAnd TMZ always survives and wins, because slander/defamation is a HIGH BAR in the US.
Offkai would obviously tell the truth in a court of law, but they said it themselves that they made their decision independently.
So Niji would have to prove otherwise.
