The fanartist can still claim that the clipper was using their fanart without permission, which is enough for a copyright strike. Doesn't matter who owns the original character so long as the fanartist isn't the one profiting.

Not really. Any claim filed by a fanartist will fail. Fanartists have no protection against a DMCA counter claim, and even if they did nobody whose small enough to care can afford to go into arbitration or to court over it.

Eh, in Japan the copyright laws are different. Much stricter. The artist actually does own the sole rights to distribute their secondary creation, even if they don't own the characters. But if the anime corp sees it first they're fucked.
I don't think this artist is Japanese though so that's irrelevant.

If the artist is in Japan he has to hire a lawyer before doing anything, one of the reasons the DMCA exists to give poorfags a chance, and that's where "nobody whose small enough to care can afford..." comes back into play.
