The former does not apply to shad because his art is cartoony as fuck but the latter definitely does. I'm amazed his biggest legal trouble was with fucking Roblox of all things and not the fact that he has repeatedly created sexual imagery and straight up porn based on real children.

Wendy has become an established character, is not solely depicted as a child and has no real basis on the person who modeled for her other than "redhead girl with twintails" which is incredibly vague. There are a plethora of examples you could have gone with that actually strike a resemblance to the real-world person the art is based on.
