Not enforcing rules makes it more difficult to enforce rules in the future, as employees can argue an expectation has been set that rules won't be enforced, and you'd be hard pressed to explain the difference in the way a court is going to care about, especially in JP where courts are EXTREMELY protective of employee rights.
