This is generally true but its very loose in most western countries. Thats why twitch can get away with all their emotes because nobody cares and no copyrights get lost.

In japan however... if you let one thing slip through the cracks you lose your copyright so they have to go full nintendo

Well you're wrong. Nintendo acts the way it does banning stuff like AM2R and Pokemon uranium because if it doesn't ban the fan games and they become acceptable it becomes legal to monetize them because nintendo lost its rights

That's not true. That's a justification you made up which has no bearing on reality. Nintendo C&Ds fan games purely because it wants to. You never lose your copyrights if other people use them and you don't sue them. That's something that applies to trademarks
