>>1410658It seems like your having some confusion between a copywrite and a trade mark. Let me clear it up, copywrite protects creative works while trademarks protect protect a companies name and logo. Super Mario Brothers is a video game made by Nintendo. It is protected by copywrite, not by trademark. If you used Nintendo's logo and their name they would have a right to sue, however copywrite does not use trademark dilution. The concept of dilution isn’t directly applicable to copyrighted properties.
This is to prevent exactly what your proposing which would easily allow for monopolies to form and dominate a word / title. Nintendo has yet to form a plumbing company, so they do not have the right to claim that Super Mario Plumbing infringes on their business.
You could use the word Spider Man in your company as well as use a red and black color scheme with a spider. Just as long as it's visually unique and your not in the film industry. The point being you do not claim to be using the character from Sony or Marvel. Using a companies name and logo would be infringement. Creatively adapting an IP outside of it's original target market is fair use.
