Yes you can.

In principle S/PDIF has a copy protection flag, but nothing uses it. You'll have to chop the stream into tracks and metadata it manually.

Bear in mind you will get transcoding loss if you recompress it again using a lossy format.

If you're paying for Spotify you get to enjoy the music without the hassle of having to pirate it.
