Except at the end she's only graduated middle school. At best, she's almost 15, like Ruri who was 15 and in highschool after the first Christmas. I'm pretty sure I remember her being declared as a full year older than Kirino, but the wiki pits Kirino as "14-15" and Kyousuke as "17-18." (Ruri is "15" and Saori is "15-16")
At best Kirino is around 15 (and "14-15" is probably derived from before her actual birthday was released, so most likely she's actually still 14), subtract 2 years and you get 13 at best, or 12 possibly. Meaning Kyousuke felt up his 12-13 year old sister...
Although, Kirino's birth year isn't given but Ruri's is. 1996. If Oreimo takes place the same year the anime was shown, October to December 2010, then Ruri would really be 14 at the time and she would be 15 by the time school would've started. This pairs up with the ONA episodes somewhat, December 2010 to July 2011. So if Ruri's birthday is accurate for the setting, Kirino's should be as well, and since Kirino is still in middle school (albeit abroad) whilst Ruri is in highschool, then she must be 14 when Ruri is 15. Thus, presumably, her birth date is April 8th 1997. Which should set her up as barely 13 (or thereabouts) by the falling event.
