Soon as they can't lie, they suddenly have nothing bad to say about Democrats.
https://lawandcrime.com/high-profile/i-dont-recall-attorney-who-previously-said-fulton-county-da-absolutely-began-dating-trump-rico-special-prosecutor-before-hiring-him-has-sustained-memory-lapse-in-court/ An unforced tactical error by a special prosecutor working for the Fulton County District Attorney’s Office led to a bit of a wash in court on Tuesday afternoon during a pretrial hearing in the racketeering (RICO) case against Donald Trump and others.
“I don’t recall,” was the phrase du jour during testimony from divorce attorney Terrence Bradley as he answered question after question about a litany of issues regarding the romantic relationship between District Attorney Fani Willis and special prosecutor Nathan Wade.
The witness, under scrutiny for why he previously said the pair “absolutely” began dating before Willis hired Wade, was often evasive under oath. He frequently had to have his memory refreshed about past statements. And, at least once, he changed his answer to a question after being shown an exhibit that disproved his earlier testimony.
Asked point blank about whether he lied when he previously made claims about the timeline of the relationship, roughly 10 seconds passed before Bradley tentatively answered: “Did I lie?”
“That’s a simple question, Mr. Bradley, you’re a lawyer,” defense attorney Richard Rice, who represents Robert Cheeley, retorted.

That doesn't mean it will affect the outcome, because apparently the judge in this case literally donated money to Fani Willis when she was running for office... But if you want to address reality for a second, the fact that this guy won't corroborate their story that they actually weren't having sex before Fani hired Nathan Wade because he won't risk his license doesn't look flattering for them.

That's not how this works. That's not how any of this works.
Also, whether or not they were fucking beforehand isn't even the primary issue here. The immediate question is "is something about the situation prejudicial to Trump". There's a second ethical question about her either profiting from the case or choosing the lawyer because of a pre-existing relationship, but even if there were evidence of ethical violations (which there are not) that might get Fani Willis off the case, but it wouldn't help Trump.

I'm actually not sure what the specific burden of proof would be in this case, (shouldn't it be the appearance of impropriety? I imagine it's not, though, because we're way, way past that)

>>1272280 >A witness who was in the middle of the whole "affair" who gets called to testify and suddenly "doesn't remember anything" can lead to plenty of conclusions being made by the jury, or in this case the judge, numbnuts. 1. Adverse inference can only be used in civil matters. So no, what you're talking about can't happen. You actually have to fucking prove your case in criminal matters. You want someone to be considered lying, you have to produce evidence to the contrary. A thing Trump's lawyers have utterly failed to do. You could have the shittiest witnesses in the world, but as long as there's nobody to challenge their story and no evidence to the contrary, a judge isn't going to say they were lying.
2. Burden of proof is on the Trump team in the motion against the state.
3. The guy wasn't "in the middle of the whole 'affair'". He talked about the affair with the guy once and didn't remember when that conversation was. He had no and did not ever claim to ever have had any first hand knowledge of them hooking up before the dude was hired. Likewise he had jack shit as far as physical evidence or communications to back up the claims against the prosecution.
4. Even if he had actually fucking delivered, this shit still isn't fucking prejudicial to fucking Trump. He's not gonna get a less fair trial because the DA and special prosecutor are literally in bed together when they were already figuratively in bed together. Beyond that, they broke up fucking months ago.
tl;dr Trump's team literally doesn't have any evidence or testimony to prove their case. They have an allegation and that's it.
