Other companies have made iconic plastic soldier armies over the years (Marx, BMC, Matchbox, Airfix to name a few). Generally speaking I don't think any sculpts are "public domain", though it doesn't deter the countless clones, copies, re-clones and recopies that have become your average dollar store fare. There's also modern companies like Armies in Plastic that produce their own sculpts, while Marx and other older ones have had re-issues in recent times.
