Unlike requiring updates for new games to force firmware updates, they can't update Pokemon the same way because they can't require consistent online access. This means someone could hack pokemon the moment the code was cracked, trade it to a local version with any updates from going online, and that updated version trades your hackmons to the internet (this assumes that you can't trade online if you don't update, which is potentially possible)
Already happening with the flashcarts. Nintendo can't do shit to stop flashcart use on 3DSes with outdated firmware.
Only solution is that the game you're talking about would demand online access at all times, which is untenable for a portable series and unthinkable for a pokemon game.
