Think of it more like music. Whatever company who has published your shit holds the rights to it, but they can't force you to keep making music if you don't want to. All they can do then is keep beating people over thehead with your greatest hits.
Game Freak is majority owner of the entire brand too, so what they say goes.
If they want to stop and want it all to stop, there's nothing Nintendo can do about it.
Nintendo has no control over them.
