Technically yes you are correct, neither you nor I have access to the evidence directly proving malicious intent behind the use of he bot, though I do consider it highly unlikely that a decision which took place 6 months after the end of the tournament, thus implying an extensive investigation to provide undeniable evidence to reach said conclusion, on top of the rather explicitly implied confession on behalf of Mazar that he did in fact use the bot for this exact purpose from the OP, as can be inferred from the comments quoting him about how the bot could be used in any tier outside of OU.
Also Mazar was already banned for 6 months before, due to ghosting, and was considered reformed after that and welcomed back into the community, as the video had said, meaning that he was effectively already given a warning against such behavior, was considered to have learned his lesson and changed his ways, and then committed this, so no third chances in that case, also how doesnt the analogy work, the players didnt want spectators joining, thats why the bot used a bot account so the join message wouldnt pop-up, its effectively the same thing as wanting to lock your house, or shop so that no one comes and steals your shit, but someone manages to sneak in before you are able to do so, the fact that people would be there while the intruder was there is irrelevant since he was invisible
