That's a very rare case tho, usually someone ends up getting the ownership of the IP if the original publisher dies. For example, the Pepsiman game was made by KID (the VN company that made Ever17). KID declared bankrupt and was bought by Cyberfront. Then Cyberfront declared bankrupt and was bought by 5pb. So if someone wants to stream that game, they need to ask Pepsi AND 5pb. It's usually not worth the effort.
