They commissioned him, idk if they communicated or not between then and when he showed them the model. But at some point, he showed them that model, they looked at it, saw that it was an identical model to Vei, and still decided "yeah fuck it no one will care"
The second thing that baffles me is that people really DON'T seem to care, the line "Well it's the same artist" is tossed around but is that really the precedent we wanna set for our Oshi's? If an artists can't make two completely separate models then he shouldn't be getting commissioned for models at all.
