NijisanjiEN admitted to violating British Columbian Employment Law

No.68409400 View ViewReplyOriginalReport
Disclaimer that it's open public information from herself that Dokibird (formerly Selen) is Canadian (stated on her Twitter profile) and resides in Pacific Standard Timezone (on her schedule), British Columbia is the only province in that timezone and her location is relevant here.

By hiring a British Columbia resident, even as a foreign company Nijisanji is subject to the BC Employment Standards Act for those residents. The act is enforced by the provincial agency WorkSafeBC and their website has extensive documentation on their policies and practices for enforcement. IN THEIR OWN STATEMENT Niji admits to violating the Employer Duties regarding Workplace Bullying and Harassment: Repeatedly harassing her via emergency contact to negotiate (aka work-related activity) regarding something non-urgent while she was in hospital, detailed in purple in picrel. They also admit (via her claim that she had not publicly alleged) that there's liver on liver harassment which is something they are responsible for stopping. While there's obviously a lot of other alleged violations of the BCESA Doki could and should go for, I think it's worth pointing this first one out because they openly admitted to it.

BC courts already heavily favour the employee in cases of he-said she-said with no documented proof, there's likely extensive text/call logs of both public and private violations of the act. Claims made through WorkSafeBC also don't go through the standard court system so legal costs for the worker are rarely more than the consultation with a lawyer on the best wording and evidence to use to file, and thus there's very little reason for Doki to not do so. It's impossible to know how much she may receive in pay compensation, but even if it's minimal there'll at least be a sense of satisfaction that a black company faces at least SOME consequences that they've otherwise been avoiding due to Japan's backwards defamation laws.
P.S. They could also be taken to court for defamation as many things in their statement are provably false but that would be a full battle. She could do it and win but it would be stressful.
