The manufacturer removed the caffeine willingly, rather than challenge it via an expensive court battle. The FDA didn't even ban selling products that have both caffeine and alcohol. Espresso martinis (and other drinks with coffee) come and go as a trendy drink every 4-5 years. Lately, more brands are releasing "hard iced tea" products with both caffeine and alcohol. The public outcry about 4Loko was because the wrong kind of people were into it, in the wrong ways.
It was a class thing, but Americans are culturally blind to conversations about class.
I'm fine with it, just amused that no one calls it what it is. I'm fine making it ten percent more difficult for the yoots and the hoodlums to buy 20oz of caffeinated alcohol that tastes like a soda.
