>>1750282I'm going to take the obvious bait, but I don't really like the idea of this moron saying such bullshit even if it's "ironic" and "for teh lulz".
Yes, you absolute fucking cretin, the action of the lewd RFA clipper does breach terms of conditions and does NOT fall under fair use. You sound like so many armchair lawyers on the Internet that claim they know jack shit about fair use and copyright law because they watched a couple videos about it, but you are openly clueless but how you are trying to defend such faggotry.
Clipfaggots do not have a claim to fair use in their actions. None whatsoever. Every single clipper could have their channel nuked off the platform by hololive, Nijisanji, VOMS, Vshojo, basically any agency. They don't do this because clipping is beneficial. It is effectively free advertisement. It is why so many of them don't bother clipping or subbing themselves. Free labor. This is typically a mutually beneficial relationship.
For the most part, I don't have any problem with clippers, as long as they remain on topic and focused on the creator. I myself got into hololive by watching clippers. Until I finish my Japanese studies, it will be the predominant way I continue to consume Japanese v-tubers. Clippers perform a service for people like me.
My issue with them starts when they start taking what the creator is saying out of context, or twisting their words, breaths, moans, or whatever into their design, that is when it becomes an issue. This is precisely what happened with the lewd RFA clip, as well as the "Succ" clip from above. You might also say that when they change the content is this way, that is being transformative, but this is not true and again evident of a misunderstanding of fair use. Please review actual cases of fair use where the result as transformative, and you will never see a single result where something akin to clipfaggotry was defensible in court.
I will further state that I have nothing wrong with Rule 34, and I probably have more hentai, doujins, and general lewds saved than anyone else here. That being said, I and most normal people draw the line when it starts involving actual people without their consent. This includes their voice, dumbass, as well as their likeness.
People do not lose authority over their image or voice when they are publicly broadcasted (
>>1750769 you are well intentioned but also incorrect in this respect). Depending on the contractual specifics, Gura's voice while providing content for the Gawr Gura channel are either owned partially by her or entirely by Cover Corporation, not (You) or other clipfaggots. You do not have any authority to do with it whatever you wish. Her voice does not become fair use because you wish it so. Cover and/or Gura are under every legal obligation to restrict clipfaggots or other users from sharing her voice or manipulating it in the way the above clipfaggot did.
If you are not trolling, you are an honest to God disgusting human being, and I genuinely recommend you log off for a few weeks and come to terms with how gross you are a person. You have a fundamental misunderstanding of how the world works, and your sheer ignorance is appalling. Do not claim to know how the world works and cite shit when you have the intelligence and world experience of a middle-schooler. I know you don't care given by how inconsiderate you are of her wishes, feelings, and capacity to consent, but Gura would honestly think so little of you.
While I don't agree with Internet censorship or content suppression, those that do use idiots like (You) as their evidence for why it should be stronger.
