Body-camera video of a Border Patrol agent involved in the shooting of a woman who was allegedly chasing agents in Brighton Park over the weekend shows an officer saying, “Do something, b----,” before pulling over and shooting the woman five times, the woman’s attorney said in federal court Monday.

The video appears to contradict the government’s allegation that Marimar Martinez, 30, drove toward officers before one of them opened fire on her late Saturday morning on Kedzie Avenue near 39th Street, her attorney, Christopher Parente, said at a detention hearing at the Dirksen Federal Courthouse.

U.S. District Judge Heather McShain denied a request by the federal government to detain Martinez and Anthony Ian Santos Ruiz, 21, pending trial. Martinez and Ruiz, who wore orange jumpsuits for the detention hearing, were charged Sunday with felony assault of a federal officer.

Parente also offered to play an agent’s body-camera video that shows the shooting, noting prosecutors did not show the video that he claimed disputes the government’s version of the shooting.

Parente said the video shows an agent turning a federal vehicle left into Martinez’s vehicle, after which an agent says, “Do something b----.” The agent then exits the vehicle and shoots at Martinez.

Speaking to CNN on the issue of sending National Guards to Oregon, the top Trump aide seemed to suggest that Trump has plenary authority - the absolute power to make the decision.

The controversial claim turned awkward when Stephen Miller froze before the camera after speaking about plenary authority, possibly after being reminded by an aide about the issue with his statement. Some said it was a technical glitch, as Miller was seen suddenly freezing in front of the camera. Others noted that Miller was blinking, suggesting he deliberately stopped.

"Well, the administration filed an appeal this morning with the Ninth Circuit," Miller says. "I would note the administration won an identical case in the Ninth Circuit just a few months ago with respect to the federalizing of the California National Guard under Title 10 of the US Code." he then says, "the president has plenary authority..." before suddenly stopping.

Plenary authority means complete, absolute, or full power to act on a particular matter, without needing approval or limitation from another body. In this case, it refers to when a president or governor claims full decision-making power within their constitutional limits.

However, contrary to Miller's claim, the President of the United States does not have plenary authority. The power of the President comes with a lot of checks and balances, sometimes in the form of Congress, sometimes in the form of legal and procedural requirement.

One week into the government shutdown, top Republican leaders appear to have lost the plot.

President Donald Trump, Speaker Mike Johnson and Senate Majority Leader John Thune are straining to project a united front against Democrats, just barely concealing tensions over strategy that have snowballed behind the scenes since agencies closed last week.

In one stark example, Trump scrambled the congressional leaders’ messaging Monday when he told reporters in the Oval Office he would “like to see a deal made for great health care” and that he was “talking to Democrats about it.”

Within hours, Trump walked it back: “I am happy to work with the Democrats on their Failed Healthcare Policies, or anything else, but first they must allow our Government to re-open,” he wrote on Truth Social hours after his initial comments.

Johnson said Tuesday he “spoke with the president at length yesterday” about the need to reopen agencies first, while Thune told reporters there have been “ongoing conversations” about strategy between the top Republicans.

A White House official granted anonymity to speak about the circumstances behind the president’s statements said the Truth post was “issued to make clear that the [administration] position has not changed” and was not done at the behest of the two leaders.

But tensions surfaced again Tuesday after a White House budget office memo raised questions about a federal law guaranteeing back pay for furloughed federal workers — one that Johnson and Thune both voted for in 2019.

Illegal crossings at the US-Mexico border have hit the lowest level in over half a century, according to federal data obtained by the BBC's US partner CBS News.

In fiscal year 2025, which spanned four months of former President Joe Biden's administration, US Border Patrol agents stopped 238,000 migrants crossing the southern border illegally, the Department of Homeland Security figures suggest.
During Trump's first eight months in office, there have been fewer than 9,000 illegal crossings recorded each month, CBS reported.

It is the lowest number of apprehensions since 1970, when border patrol agents stopped 202,000 people crossing the US-Mexico border unlawfully.
"The numbers demonstrate progress on border security," said Jennie Murray, president and chief executive of the National Immigration Forum, adding that both parties and the White House need to work on passing immigration legislation.

Patrol agents made over half of the apprehensions at the border during the first three months of the 2025 fiscal year, which ran from October 2024 to September 2025, during Biden's tenure, according to the preliminary data.
The apprehensions indicate the number of times border police stopped and processed migrants entering the country illegally at official ports of entry, which may include people who attempted to cross the border more than once after being stopped.

US Customs and Border Patrol has said about 11 million border encounters were recorded over the course of Biden's four years in office.
